Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion.
  2. Purchase necessary. Please retain promotional pack and all receipts as proof of purchase.
  3. No purchase necessary in Northern Ireland.
  4. Internet access required for the £/€50 hourly prizes draws and late entry prize draws. Prize money will be doubled to £100 exclusively at Tesco, UK only.
  5. Winners must hold a U.K. or ROI bank account.
  6. Maximum of one (1) prize type, £10,000 (€10,000) and £50 (€50), doubled to £100 exclusively at Tesco, UK only, per person and maximum of one (1) prize type, £10,000 (€10,000) and £50 (€50), doubled to £100 exclusively at Tesco, UK only, per household only during the promotional period. Winners of the £/€10,000 will be fulfilled via cheque and winners of the £/€50 prizes (doubled to £100 exclusively at Tesco, UK only) will be fulfilled via BACS bank transfer or cheque. Max. 2 entries per person, per day during the promotional period.
  7. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.
  8. Each entry to the prize draw must have a new pack and unique receipt as part of the entry requirements. Anyone trying to circumvent the rules stated in these Terms & Conditions by using alternative details will be disqualified from this promotion.

Promotional Period

  1. The promotional period in which to claim a lucky bar is from 00:00 on 01.02.21 until midnight on 14.01.22.
  2. The core promotional period for the hourly prize draws, to win 1x £/€50 every hour (between 9am – 7pm daily), doubled to £100 exclusively at Tesco, UK only, is from 01.02.21 to 28.03.21.
  3. After the core promotional period, there will still be an opportunity to win 1 of 10x £/€50 in each of the 3 late entry draws, doubled to £100 exclusively at Tesco, UK only:
    1. The first late entry draw period will run between 00.00 on 29.03.21 and midnight on 30.06.21.
    2. The second late entry draw period will run between 00.00 on 01.07.21 and midnight on 30.09.21.
    3. The third late entry draw period will run between 00.00 on 01.10.21 and midnight on 31.12.21.
  4. Entries, depending on times, will be accepted into the relevant promotional draws detailed. Entries are valid for the applicable draw only and will not roll over.

Entry Requirements

  1. There are 8x £10,000 (€10,000 for ROI winners) prizes, available to be won instantly by purchasing a promotional pack of KitKat® (while stocks last- see Clause 19 for participating products) and finding a lucky bar and winning insert inside. Winning inserts contain details on how to claim. The £/€10,000 prizes will be fulfilled via cheque.

    Please note that the 8 lucky winning bars have been randomly seeded from the total universe of the products available in this promotion and therefore not all product variants may contain winning bars. Not all prizes may be claimed.

    Lucky winning Multipacks will contain only one winning insert, which will be required to validate the claim.
  2. To enter for your chance to win a £/€50 prize (doubled to £100 exclusively at Tesco, UK only) supplied as a BACS bank transfer or cheque, participants must:
    1. Purchase a participating promotional pack of KitKat® whilst stocks last (see clause 19 for participating products);
    2. Visit www.kitkat.co.uk and follow the directions to the promotional microsite;
    3. For the Tesco, UK only, exclusive entrants must then confirm that they purchased the pack from ‘Tesco UK’ in the drop down menu of participating retailers when registering their promotional barcode
    4. Enter their full name, email address and 13 digit barcode.
    5. Select their country of residence, either UK, Channel Islands & Isle of Man or ROI, and county.
    6. Entrants into the core promotion will be entered into that hour’s prize draw and be notified, by email, the next working day if they are a winner. Weekend draws will be drawn the following Monday and winners notified on the same day.
    7. Entrants into any late entry draws will be entered into their respective prize draw and will be notified, by email, the day after the closing date if they are a winner.
    8. If a Tesco, UK only, shopper is selected as a winner, they will be asked to submit their Tesco, UK only, receipt during the validation process and will have their £50 prize money doubled to £100.
  3. Please retain your promotional pack and each entry’s receipt as you may need this for verification purposes.
  4. The receipt can only be used once. Entrants who do not give correct details, provide inaccurate or the wrong receipts or those who make an entry on someone else’s behalf will be disqualified.
  5. Incomplete, illegible, misdirected or entries received outside any promotional period will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
  6. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: KitKat® Break from Bills Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a promotional code will be provided via email, which can then be entered on the microsite in order to enter one of the hourly prize draws for a chance to win the £/€50: to be won in the every hour prize element of the promotion. In addition, your NPN entry will be entered into the promotion with the same opportunity of winning the lucky bars as the purchase necessary route. NPN Winners ONLY will be subsequently contacted by email in the first instance with details of how to claim the prize. Only one entry per stamped, correctly mailed envelope. A maximum of 2 entries per person, per day. No Purchase Necessary applications must be received by the Promoter no later than 19.03.21 to ensure that requests can be processed before the end of the core promotion. No Purchase Necessary requests will be subject to verification.

Prize Details

Terms & Conditions for £10,000/€10,000 prizes

  1. There are 8x £10,000 (€10,000 for ROI winners) prizes available to be won via randomly seeded winning lucky bar packs.
  2. Any lucky bar found must be claimed by 14.01.22. After this date, any unclaimed lucky bars will be declared null and void.
  3. Maximum one (1) x £10,000/€10,000 prize can be won in total per person and maximum of one (1) prize (£10,000/€10,000) per household throughout the promotional period.
  4. Winners of the £10,000 prize will be fulfilled via a single £10,000 cheque to UK, IoM or CI winners. Winners of the €10,000 prize in the Republic of Ireland will be issued a single €10,000 cheque. Winners must fill out their address details within 14 days of receiving their win confirmation email or their prize will be forfeited.
  5. For all £10,000/€10,000 prize payments, cheques will be sent via Royal Mail Special Delivery, guaranteed by 9am, but please allow 28 days for receipt of prize after claim and verification. Winners in Ireland will have their cheques sent via International Tracked and Signed For postage.
  6. Once the cheque has been issued and delivered to the winner’s address it is the responsibility of the winner to cash the prize and immediate deposit is recommended. The promoter will not issue any replacement cheques.

Terms & Conditions for £/€50 prize draws (doubled to £100 exclusively at Tesco, UK only)

  1. The ‘Double your prize to £100 at Tesco, UK only’ draw is a promotional event exclusive to Tesco shoppers in the UK only.
  2. Draw Overview: Tesco, UK only, shoppers who enter the KITKAT ‘Break from Bills’ on pack promotion, online, will be entered into one of the hourly core national promotion or 3x late entry draws with all other retailers. If a shopper is drawn as that hour’s winner or in the late entry draw and has selected ‘Tesco UK’ when entering the promotion, their £50 prize money will be doubled to £100 exclusively at Tesco, UK only. Subject to full verification process.
  3. Shoppers from any retailer entering the ‘KitKat® Break from Bills’ promotion will have the same opportunity of winning.
  4. Total of 560x £/€50 prizes to be won, doubled to £100 exclusively at Tesco, UK only, in 560x prize draws (560x winners to be chosen in the core promotional period) via hourly draws, 01.02.21 – 28.03.21. A winner will be chosen every hour between 9am – 7pm. Weekly draws (Monday to Thursday) will be drawn the next working day, weekend draws Friday, Saturday and the Sunday draw will be drawn the following Monday.
  5. 30x winners of the £/€50 (doubled to £100 exclusively at Tesco, UK only) will be chosen in 3x late entry prize draws (10x winners in each late entry draw):
    1. 00.00am on 29.03.21 and midnight on 30.06.21
    2. 00.00am on 01.07.21 and midnight on 30.09.21
    3. 00.00am on 01.10.21 and midnight on 31.12.21
  6. Maximum one (1) x £/€50 prize can be won in total per person (doubled to £100 exclusively at Tesco, UK only) and maximum of one (1) prize £/€50 per household (doubled to £100 exclusively at Tesco, UK only) throughout the promotional period.
  7. £/€50 (doubled to £100 exclusively at Tesco, UK only) prize winners must select their preferred payment method and provide all relevant information for their chosen route by clicking the link in the winner’s email redirecting them to the microsite.
  8. For BACS payments, winners must fill out their Account Name, Bank, Account Number and Sort Code within 14 days of receiving their win confirmation or their prize will be forfeited. ROI winners must also supply their IBAN Number.
  9. For cheque payments, winners must fill out their address details within 14 days of receiving their win confirmation email or their prize will be forfeited. Cheques will be issued as a single £50 (or £100 for Tesco, UK only, winners) to U.K., IoM or CI winners or a single €50 cheque to winners in the Republic of Ireland.
  10. For all £/€50 (doubled to £100 exclusively at Tesco, UK only) prize payments, cheques will be sent via Royal Mail, Sign For 2nd Class and please allow 28 days for receipt of prize after claim and verification. Winners in Ireland will have their cheques sent via International Tracked and Signed For postage.
  11. Once the cheque has been issued and delivered to the winner’s address it is the responsibility of the winner to cash the prize and immediate deposit is recommended. The promoter will not issue any replacement cheques.

How to claim prizes

  1. For the £10,000 (€10,000 for ROI winners) prizes, see details on insert inside lucky winning bar/ pack. There will be one winning insert only inside each winning packaging. Further instructions will be given to the winning entrants including the posting of various “winning items” to a claim address in order to commence and validate the claim process.
  2. Claims from any lucky winning bar/ pack must be made by 14.01.22. Allow 28 days for receipt of prize after claim and verification.
  3. For the £10,000 (€10,000 for ROI winners) winners, their claim will first have to be verified by Nestlé Consumer Services and an independent third party, following receipt of information as stated on their winning insert together with their promotional pack.
  4. For the £/€50 (doubled to £100 exclusively at Tesco, UK only) prizes, winners will be randomly selected from all genuine, valid entries, every hour via an independently verified process. Weekly draws (Monday to Thursday) will be drawn the next working day. Weekend draws (Friday, Saturday and Sunday) will be drawn the following Monday.
  5. For the 30x £/€50 (doubled to £100 exclusively at Tesco, UK only) prizes to be won in the 3x late entry draws, winner will be drawn and verified the day after the close of each late entry draw. Winners will then be contacted via email and must claim their prize within 14 days.

Winner selection and notification

  1. A total of 8 winning lucky bars with a winning insert have been randomly distributed via an independently verified process into promotional stock available for distribution to the marketplace thus allowing consumers the opportunity to purchase them during the promotional period. If your promotional KitKat® does not contain a lucky bar or winning insert, then unfortunately you have not won this time.

    Please note that the 8 lucky bars have been randomly seeded from the total universe of the promotional products available and therefore not all product variants may contain winning bars.
    Lucky winning Multipacks will contain only one winning insert, which will be required to validate the claim.
  2. For the £/€50 prizes, (doubled to £100 exclusively at Tesco, UK only) winners will be randomly selected from all genuine, valid entries, every hour via an independently verified process. Weekly draws (Monday to Thursday) will be drawn the next working day. Weekend draws (Friday, Saturday and Sunday) will be drawn the following Monday. Winners will be contacted via email and requested to confirm the claim process, including the relevant receipt within 14 days. If the winner has entered multiple times, the Promoter reserved the right to request receipt proof of all of the entries.
  3. Winners must be the account holder of the bank account which the BACS bank transfer or cheque is deposited into.
  4. If winners select cheque as their preferred claim method, winning cheques must be sent to a winner’s permanent U.K., IoM/CI or ROI residence and immediate deposit is recommended.
  5. In the event that any winner is disqualified from the core promotion, or fails to respond within the stated timescales, the Promoter reserves the right to withdraw the prize.
  6. 30x winners of the £/€50 (doubled to £100 exclusively at Tesco, UK only) will be chosen in 3x late entry, prize draws (10x winners in each late entry draw):
    1. 00:00am on 29.03.21 and midnight on 30.06.21
    2. 00:00am on 01.07.21 and midnight on 30.09.21
    3. 00:00am on 01.10.21 and midnight on 31.12.21
  7. All valid entries from each Late Entry Prize Draw will be independently verified by a third party the day after each promotional “late entry” close date. Winners will have 14 days to claim their prizes. Failure of winners to claim within these timescales allows the Promoter to reserve the right to withdraw the prize.

General

  1. The Promoter’s decision is final with regard to all promotional matters.
  2. Proof of entry is not proof of purchase. Responsibility cannot be accepted for entries that are lost, damaged or delayed, nor any associated costs to entrants.
  3. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack and receipt for each entry as proof of purchase in order to verify their claim.
  4. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  5. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.

  8. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions;
    2. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    3. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    4. Any unauthorised access to, or theft, destruction or alteration of codes at any point during the operation of this promotion.
  9. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  10. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  11. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 14 calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.
  12. By taking part in the promotion, winners agree that Nestlé may contact them to ask whether they want to participate in marketing activities relating to the promotion.
  13. Winners of both the £/€10,000 and £/€50 (doubled to £100 exclusively at Tesco, UK only) surnames’ and counties’ will be available by sending an email request to consumer.services@uk.nestle.com with ‘WINNERS LIST: KitKat® Break from Bills’ in the subject line, for a period of 3 months following the end of the core promotion period. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy and the Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘Nestlé Break from Bills promotion’. The promoter nevertheless will disclose the information to the Advertising Standards Authority if required to do so.
  14. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  15. By taking part in the promotion, entrants acknowledge that they may be required to take part in relevant reasonable publicity without further payment. Such publicity may include, without limitation, the entrants name and/or if consent given, image or statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion.
  16. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  17. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of verified winners will be made available as set out in Clause 62 above and winners can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable.
