Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.


  1. The promotion is open to UK (England, Scotland, Wales and Northern Ireland), Isle of Man, Channel Island and Republic of Ireland residents aged 18+ only and excludes employees and the immediate families of Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone professionally connected to the promotion.
  2. Internet access required.
  3. Purchase required (NPN available for Northern Ireland residents). Please retain promotional pack as proof of purchase.
  4. Consumers can enter the promotion as many times as they want, so long as they have a unique promotional code for each entry. Maximum of 5 prizes per person. 8 designs are available while stocks of each of the designs last. Anyone trying to circumvent this rule by using alternative details will be disqualified from this promotion. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified and any prize awarded will be void.

Promotional Period:

  1. Promotional Period is from 00:00 08.01.18 to 23:59 31.08.18 and prizes will not roll over.

How to enter:

  1. To enter participants must:
    • Purchase a participating promotional pack of KITKAT (see clause 9 for participating products);
    • Visit www.kitkat.co.uk and follow the directions to the promotional microsite;
    • Enter your full name, email address and the unique 12-character promotional code found inside promotional packs to find out instantly online if you are a winner;
    • Winning entrants will be notified on screen and asked to follow the instructions to claim their prize and select their chosen design from any of the 8 available options (while stocks last). Winners will also be sent a confirmation email.
  2. Promotional codes can only be used once. Entrants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified.
  3. To enter without purchase in Northern Ireland only – send your name, age, full postal address and email address to: KITKAT WIN Joe the Mug Promotion NPN, Consumer Services, Nestlé UK Ltd, Haxby Road, York, YO91 1XY. Once the request has been verified, a promotional code will be provided via email, which can then be entered on the microsite in order to enter the promotion. Only one entry per stamped, correctly mailed envelope. A maximum of 3 entries per person per day. NPN applications must be received by the Promoter no later than 24.08.18 to ensure that requests can be processed before the final closing date.

    This applies when the pack features the ‘WIN Joe the Mug’ promotional flash, and while stocks last.


  1. 50,000 prizes are available to be won instantly. There will be the following quantities of each prize available, each mug will reveal a message on the back of mug when heated (shown in brackets):
    - Dapper Joe x 5,500 mugs (Have a Dapper Break)
    - Chatty Joe x 5,500 mugs (Have a Chatty Break)
    - Dreamy Joe x 5,500 mugs (Have a Dreamy Break)

  2. Each prize consists of one Joe the Mug (branded white ceramic thermochromic mug). Winners have the option, whilst stocks last, of 8 different Joe the Mug designs to choose from (subject to availability). Joe the Mug will be delivered in a presentation box to the winner’s provided postal address within 28 days following completion of the online claim and verification process.
  3. Each Joe the Mug is thermochromic, and will reveal a new design on the back of mug when heated, by filling with hot water (See clause 10 for details)
  4. Joe the Mug is not dishwasher safe.
  5. Joe the Mug is not microwave safe.

How to claim your Joe the Mug:

  1. Winners will be informed online immediately after submitting their entry that they have won. Winners will then be given the opportunity to select one of the 8 mug designs which they can then redeem by entering their claim information including full postal address.
  2. This claim process must be completed in full by 07.09.18 in order for you to receive your chosen mug, there is not the possibility of reserving a mug and completing the claim process at a later date. You will not lose your winner status but it should be noted that stocks for all 8 designs are subject to availability, therefore to avoid disappointment you should choose your mug at the earliest possible convenience.
  3. Users will be able to see the quantity of each mug that is available at any given time by visiting the Prizes page of the website. In the event there is a minimal amount of mugs of a particular design available and there are additional claims received from other winners whilst you are contemplating your decision this action will only be updated if you refresh the stock level situation before you decide. In the unlikely event that your chosen design is no longer available you will have to choose from one of the other designs still in stock.

Winner selection and notification:

  1. Prizes have been randomly allocated and linked to ‘winning moments’ that have been randomly pre-selected by a secure independently verified computer programme. There are 50,000 winning moments available throughout the promotional period. The first person to enter a unique promotional code on or after the allocated winning moment will have been deemed to have won. All prizes are available to be won. Winners will be notified online immediately after entry and will also be sent a confirmation email. Winners must then follow the on-screen instructions in order to verify and claim their prize.
  2. In the event that any winner is disqualified from the promotion, the Promoter reserves the right to withdraw the prize and reallocate the prize to the prize pool.
  3. Any prize left unclaimed after 07.09.18 will be deemed void.


  1. Winners will be subject to a full verification process. Winners may be asked to provide their promotional pack with the unique code and proof of purchase in order to verify their claim.
  2. Proof of entry is not proof of purchase. Responsibility cannot be accepted for claims that are lost, damaged or delayed, nor any associated costs to entrants.
  3. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.
  4. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  5. All prizes are non-transferrable, non-negotiable and non-refundable. No cash alternative is offered in whole or in part and the Promoter reserves the right to substitute any part of the prize for an item of equal or greater value due to circumstances outside of the Promoter's control should any element of the prize be unavailable. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winner.
  6. Promotional codes must be entered online exactly as they appear in the pack. Each promotional code is unique and can only be used once. Attempts to enter the same promotional code more than once, the use of codes from non-promotional packs, or the use of any promotional codes not intended for use in this promotion, may result in disqualification and all entries will be declared void.
  7. The promotional codes have no value and cannot be transferred or sold.
  8. In ROI this promotion is carried out under the license issued to Down Syndrome Ireland, Unit 3, Park Way House, Western Parkway Business Park, Ballymount Drive, Dublin 12.
  9. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    i. Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions;
    ii. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
    iii. Inaccessibility or unavailability of the internet or the microsite or any combination thereof;
    iv. Any unauthorised access to, or theft, destruction or alteration of codes at any point during the operation of this promotion.
  10. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the code redemption process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  11. The Promoter reserves the right to verify all entries including but not limited to asking for the pack and relevant code, address and identity details (which they must provide within 14 days) and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
  12. To the extent permitted by law, the Promoter cannot accept any responsibility for any damage, loss, or injury suffered by any entrant as a result of entering the promotion or accepting the prize or any injury or damage to the entrant's or any other person's computer or mobile telephone relating to or resulting from participation in or downloading any materials in connection with the promotion.
  13. By taking part in the promotion, entrants acknowledge that they may be required to take part in relevant publicity without further consent or payment. Such publicity may include, without limitation, the entrants name and/or image, statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion.
  14. The Promoter's decision is final and binding in all promotional matters.
  15. The Promoter does not assume any responsibility for promotional codes damaged or defaced in the way the product packaging is opened. If you cannot read your promotional code due to a genuine printing error, you should contact Nestlé Consumer Services either by email at consumer.services@UK.nestle.com or by telephone on Freephone 00800 6378 5385 (UK + ROI). Any request for a replacement code must be received by 24.08.18 to ensure that the request can be processed before the final closing date.
  16. The full names and counties of all winners who have completed the claim process will be available by sending a self-addressed, stamped envelope, marked “Winners List” to: KITKAT WIN Joe the Mug Promotion, Consumer Services, Nestlé House, Haxby Road, York, YO91 1XY, for a minimum period of 3 months after 31.08.18.
  17. In the event of exceptional circumstances outside its reasonable control or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions at any stage but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  18. The pictures and images used in connection with this promotion and the prize and on printed materials are for illustrative purposes only.
  19. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the English and Welsh courts.
  20. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  21. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications.
