These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By participating in this promotion, you confirm that you have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility

  1. This promotion is only open to residents of the United Kingdom (England, Wales, Northern Ireland & Scotland), aged 18+ only.
  2. This promotion excludes employees and the immediate families of participating promotional sites, Nestlé UK Ltd (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion.
  3. No purchase necessary.
  4. Mobile phone and internet access required to enter the draw(s) by completing an online form to win an experience (from the available list.)
  5. Maximum of 1 entry per person / per week (Monday to Sunday), during the promotional period.
  6. Maximum of 1 x prize per person over the full promotional period.
  7. All winners must have a valid UK address to claim their prize.
  8. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
  9. Anyone trying to circumvent the rules stated in these Terms & Conditions by using alternative details will be disqualified from this promotion.
  10. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programmes, applications, scripts, alias accounts brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void.

Promotional Period

  1. This promotion opens at 00:00 on 07.10.24 and closes at 23:59 on 01.12.24. Any entries received outside the promotional period will not be accepted into any weekly draw.
  2. There are 8 x weekly prize draws in total, with prize draws taking place within 1 working day following the end of the previous week. Please see table below for each weeks start and end date, along with prize draw dates.

  3. Entries, depending on the time of entry, will be entered into the respective weekly draw only, and will not roll over from week to week.
  4. Any entries received outside of the specific dates and times detailed will not be accepted.

Entry Requirements

  1. To enter in the weekly draw, participants must:
    1. Scan the QR code found on the promotional material at promotional sites.
    2. Participants will then be shown an online entry form which must be completed by filling in their contact details to enter.
    3. Participants will then receive online confirmation that their entry into the relevant weekly prize draw has been submitted.
    4. 5 x winners will be drawn weekly, at random, via an independently verified computer process, from all valid entries. Only winners will be contacted after the prize draws to confirm the details of their prize win.
    5. All entries must be made during one of the weeks of the promotion between 00:00 07.10.2024 to 23:59 01.12.2024.
  2. Participants are advised to take care when entering their details. The Promoter is not responsible for typographical errors and incorrect details entered. Only correct entries that have followed the instructions and guidelines will be accepted. Attempted additional entries/ duplicates will not be included in the prize draws. Persistent abuse will result in immediate disqualification without notification.
  3. All entries are subject to verification. Entry information may not be sold or exchanged. In the event of suspicious activity, the Promoter reserves the right to request further evidence to confirm the legitimacy of the entry.
  4. Illegible, invalid, or misdirected entries will not be accepted. Participants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
  5. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Prize Details

  1. There is a total of 40 experiences available to won across the entire promotion period. Winners can choose from the following experiences, which will be fulfilled in one of two ways:

    BOOKING FORM

    Totally Wild Foraging, Cookery & Lunch (for 2 adults)
    • 6-hour foraging course for two at Totally Wild. Cook a wild food lunch to enjoy, learn the ins and outs of foraging from a professional and sample delicious tasters. Beverages not included.
    • Unavailable from December to February.
    • Available at 17 UK locations: Derbyshire, Nottinghamshire, Northamptonshire, Merseyside, Cheshire (x2 locations), Cumbria, Lake District, Devon, Cornwall, Somerset, West Sussex, East Sussex, London (x2 locations), Worcestershire, North Yorkshire.


    Mindfulness Day Retreat with Guided Meditation, Yoga and Lunch
    • Guided meditations, gentle flow yoga, affirmation art, walking therapy and more. Food is provided. Snacks and tea provided throughout the day. Beverages not included with lunch.
    • Experience lasts 5 hours.
    • Only available on Fridays, Saturdays & Sundays throughout the year. Excluding Bank Holidays.
    • Available at 13 UK locations: Hampshire, Kent, Berkshire, Surrey, East Riding of Yorkshire, London (x2 locations), Essex, Hertfordshire, Cheshire, Somerset, Wiltshire, Dorset.


    London Beginners Photography Workshop
    • Learn tips, techniques, and skills from a professional photographer in a photography workshop and tour in Central London. Experience includes an introduction to photography/camera, followed by a tour of Central London including Tower Bridge and City Hall. The photography experience will last for four hours in total. The pace/structure of the tour will be shaped by the number of participants.
    • Experience lasts 4 hours.
    • Available on selected Saturdays throughout the year. Excludes Christmas, New Year, Easter and all UK Bank Holidays.


    Beginner Barista Coffee Course
    • Discover how to create multiple types of coffee, as well as the impact of grinding and steaming on the quality of coffee.
    • Experience lasts 3 hours.
    • Available at 7 UK locations: West Midlands, Greater Manchester, Cheshire, Nottinghamshire, Lincolnshire, West Yorkshire, South Glamorgan.


    Introductory Classes to Yoga (for 2 adults)
    • 45-minute introductory class to yoga. Learn foundational yoga poses, breathing techniques, and relaxation exercises.
    • Experience lasts 45 minutes.
    • Unavailable on Christmas, New year, Easter and all UK Bank Holidays.
    • A third-party agent will liaise with the winner. Location of class determined upon request from winner and preferred location.


    Spa Experience (for 2 adults)
    • Choose from a morning, afternoon or twilight session during the week, including access to spa facilities, a 1 x 30-minute treatment and a choice of breakfast, lunch or afternoon tea pp.
    • Experience lasts up to 4 hours.
    • Available Monday-Friday only. Excludes Christmas, New year, Easter and all UK Bank Holidays
    • A third-party agent will liaise with winner. Location of class determined upon request from winner and preferred location.


    Indulge in a culinary masterclass (from an extensive list of different cuisines)
    • Private lesson with an industry professional, creating a starter and main each, from a choice of 10 cuisines.
    • Experience lasts up to 5 hours (dependent on class chosen).
    • Unavailable on Christmas, New Year, Easter and all UK Bank Holidays.
    • A third-party agent will liaise with each winner individually to tailor their prize to their specific needs, preferences, cuisine, and location.


    ONLINE COURSE REGISTRATION

    Interior Design Online Course
    • 15-hour Interior Design certificate course, with access to 10 modules, starting with basics to extensive practices to design a home or commercial space.
    • No date exclusions apply.


    Garden Design & Maintenance Online Course
    • Learn professional tips and techniques from industry experts in a 15-hour Garden Design and Maintenance course, as well as a £50 National Gardens Gift Voucher.
    • No date exclusions apply.


    Portrait Photography Online Course and Photoshop Online Course
    • Comprehensive 30-module online course to master the art of portrait photography & Adobe Photoshop. Adobe Photoshop software is not included.
    • No date exclusions apply.


    Learn a new language
    • Language certificate course from a choice of 10 languages. Learn from basics to conversation topics from industry experts in the comfort of your home.
    • No date exclusions apply.

     
  2. Experiences are supplied by a diverse network of suppliers to offer a wide range of options and greater flexibility for our winners.
    1. Courses and locations may change throughout the year due to factors beyond control.
    2. A third-party agent will liaise with each winner individually to tailor their prize to their specific needs, preferences and locations.
    3. A third-party agent will liaise with the winners and provide the relevant details around the experiences and accompanying booking processes.
    4. Online booking registration: A third-party agent will receive winner details and liaise directly with the winner to provide online course registration details. Booking form: A third-party agent will receive winner details and liaise directly with the winner to provide the booking form. The third-party agent will request a guide location from the winner and work on a one-to-one basis with the winner to fulfil and book the prize.
    5. Dependent on the experience chosen, a third-party agent will provide booking forms or online course registration details.
    6. Once chosen, all prizes are valid for 12 months. When booking their experience, winners will be notified of any unavailable dates.
    7. No cash alternative will be offered. The experience is non-negotiable, non-transferable and non-refundable in part or full.
    8. The experiences do not include travel, accommodation or spending money.
    9. If the experience selected by the winner is not available, then a third-party agent will offer alternative experiences where possible.
    10. Except in exceptional circumstances, the Promoter reserves the right to substitute a prize for an item of equal or greater value should a chosen prize be unavailable. Unless otherwise agreed in writing by the Promoter, the prizes will only be awarded directly to the winners.
    11. Winners acknowledge that in accepting any prize, they are agreeing to the Terms and Conditions set out.

Winner Selection and Notification

  1. Each week of the main promotional period, winners will be drawn by an independently verified random computer process from all valid entries received from the relevant week during the main promotional period.
  2. The winner will be subject to full verification process. The winner will be notified via the email address provided on entry within 3 working days of the prize draw and will be asked to provide evidence of identity and eligibility in order to claim their prize.
  3. The winner will have 14 days to claim their prize from first contact. A third-party agent will request, via a secure link, the following information to fulfil the claim; their full name, proof of age and confirmation of email address used to enter the promotion to assist with verification, fulfilment of their prize, to announce them as a winner (if no objection is received).
  4. Inaccurate information may result in a prize being forfeited. Please retain winning communication until any prize has been verified. Participants are encouraged to monitor their email account during this time in case they are a winner.
  5. A third-party agent will make 3 attempts to contact each relevant winner, however, if a winner has not responded to notification within 14 days of initial contact attempt, or if the selected winner is ineligible, rejects their prize that the Promoter offers, is otherwise in breach of these Terms and Conditions, or unable to take up their prize for any other reason, the Promoter reserves the right to withdraw the prize which will be forfeited and a reserve, drawn next in line from the original applicable draw will be contacted. These reserve(s) will be contacted in the same process. If a winner has not responded to any communication and the prize has not been awarded after attempts to contact the initial winner and the 2 reserves, then the prize has therefore not been successfully claimed, and will be deemed null and void.

Prize Fulfilment

  1. Winners will be contacted directly and prize instructions on how to book / redeem will be discussed directly with the winner upon confirmation on the desired experience, from the pre-determined list available. The prize partner will facilitate this communication to ensure the correct prize if fulfilled satisfactory. The winner is encouraged to monitor their email account.
  2. It is the responsibility of the winner to supply the correct personal information to claim their prize. The Promoter will not be held liable for non-delivery of a prize due to the provision of incorrect information.
  3. For any assistance needed with claiming your prize, please contact Nestlé Consumer Services either by email at consumer.services@uk.nestle.com or by telephone on Freephone 0800 6378 5385.
  4. Please retain any winner communication details until any prize has been redeemed.

General

  1. The Promoter shall have sole and final determination as to which entries are genuine and therefore eligible to take part in this promotion. The Promoter’s decision is final and binding with regards to all promotional matters and will not respond to any correspondence.
  2. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.
  3. The Promoter is not responsible for the acts or default of third-party agents but will endeavour to resolve any issues that may arise.
  4. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any faulty, incorrect, erroneous or failed electronic data transmissions.
    2. Any difficulties in entering or claiming, any entries/claims delayed or corrupted or any loss arising out of such an event.
    3. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilised in any aspect of this promotion.
    4. Inaccessibility or unavailability of, the internet or any combination thereof. The Promoter cannot guarantee continuous, uninterrupted access to the microsite.
  5. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  6. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by system virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  7. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address, age and identity details (passport, driving licence or equivalent), which they must provide within 7 calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
  8. By taking part in the promotion, the prize winners agree that the Promoter may contact them to ask for their consent as to whether they want to participate in reasonable marketing activities and publicity relating to the promotion. Such publicity may include, without limitation, the participants’ name and/or if consent given, image or statements made by participants concerning the promotion and/or prize obtained as part of the promotion. Winners are not obliged to agree to any request.
  9. Subject to the Promoter's Privacy Policy, the winners' surnames and counties of residence will be available by sending an email request to consumer.services@uk.nestle.com with 'WINNERS LIST KITKAT BETTER YOUR BREAK EXPERIENCE' in the subject line, for a period of 3 months following the close of the last promotional week. When contacting this email address, your request will be actioned in line with Nestlé's Privacy Policy and the Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line 'KITKAT BETTER YOUR BREAK EXPERIENCE 2024'. The Promoter nevertheless will disclose the information to the Advertising Standards Authority if required to do so.
  10. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  11. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.

Data Protection

  1. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of residence of verified winners will be made available as set out in the relevant clause above and winners can object to this by emailing UKI.dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. Click here for the Promoter’s Privacy Policy. You can request access to your personal data, have any inaccuracies rectified or request deletion of personal data by sending an email to UKI.dataprotection@uk.nestle.com. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded. Any data obtained via this promotion will be deleted after 3months after the final promotional week with the exception of the winners and reserves whose data will be deleted after fulfilment of their prize.
